(1) The implementation of the Public-Private Partnership project will be carried out by the following bodies:-
(a) If the project falls under the jurisdiction of the local level according to the prevailing federal law, the relevant local level (b) If the project falls under the jurisdiction of the state level according to the prevailing federal law, the concerned state government (c) Among the projects under the jurisdiction of the Union according to the prevailing federal law, other than hydropower and other energy projects with an estimated cost of up to six billion rupees, or in the case of hydropower and other energy projects with a capacity of 200 mega megawatts, the relevant ministry or agency of the Government of Nepal,
(d) If there is a project other than hydropower including energy projects with an estimated cost of more than six billion rupees or an energy project including hydropower with a capacity of more than 200 megawatts, the board.
(2) Regardless of what is written in sub-section (1), in the case of a project that has been identified and approved by any body according to the prevailing law, it can be implemented through a mutual understanding or agreement between the relevant body and the board.
(3) Regardless of what is written in clauses (a) and (b) of sub-section (1), the provisions regarding foreign investment in projects falling under the jurisdiction of local or state level shall be in accordance with the federal law.
(4) The Board shall coordinate with the relevant agencies while implementing the project as per clause (d) of sub-section (1).
